Buyer Agreement

1. Introduction
1.1 This Buyer Agreement ("Agreement") governs your use of the Elegantly Devious marketplace ("ED", "we", "us", or "our").
1.2 By purchasing on www.elegantly-devious.co.za, you agree to be legally bound by this Agreement.
1.3 ED operates as a curated online marketplace facilitating transactions between independent Sellers and Buyers.
1.4 ED is not the owner, manufacturer, or direct supplier of products listed on the platform.
2. Nature of the Platform
2.1 ED provides listing functionality, payment processing facilitation, dispute management, and seller payout processing.
2.2 All products are sold by independent Sellers.
2.3 ED does not take ownership of goods and does not guarantee product condition beyond the representations made by Sellers.
3. Buyer Eligibility
3.1 Buyers must be at least 18 years old.
3.2 By purchasing, you confirm that you are legally permitted to buy and possess the items purchased.
4. Orders & Payment
4.1 Payment must be made via approved payment gateways.
4.2 Orders are considered confirmed only once payment has been successfully processed.
4.3 ED may cancel or suspend orders if fraud, payment irregularities, or compliance risks are identified.
5. Delivery
5.1 Sellers are responsible for shipping and delivery of products.
5.2 Delivery timelines are estimates and may vary depending on courier performance.
5.3 Buyers are responsible for providing accurate delivery details.
5.4 Delivery confirmation may be established via courier tracking confirmation or buyer acknowledgment.
5.5 Buyers acknowledge that once the order is marked as “Collected” in ED’s system, the item is considered delivered and accepted unless a valid dispute is lodged within 24 hours.
5.6 Where delivery is made to a third-party collection point, including but not limited to PUDO lockers, delivery shall be deemed to occur at the time the order is marked as “Collected” in ED’s system following courier confirmation that the parcel has been removed from the collection point.
6. Disputes
6.1 Buyers must lodge any dispute within 24 hours of confirmed delivery.
6.2 Confirmed delivery occurs when the order is marked as “Collected” in ED’s system following courier confirmation that the parcel has been collected.6.3 Failure to lodge a dispute within 24 hours will result in the transaction being considered accepted and final, unless required otherwise under applicable law.
6.4 ED’s determination in resolving disputes is final.
6.5 Frivolous, abusive, or fraudulent disputes may result in account suspension.
6.6 Buyers may be required to provide photographic evidence, packaging evidence, or courier documentation to support a dispute.
6.7 ED may decline disputes where evidence suggests use, alteration, tampering, or handling inconsistent with an inspection-only review.
7. Returns & Refunds
7.1 Due to the intimate and personal nature of items sold on the platform, all sales are final unless a valid dispute is upheld in accordance with this Agreement.
7.2 For hygiene, safety, and privacy reasons, items may not be returned once delivered, opened, handled, or used.
7.3 Refunds will only be considered where a valid dispute has been lodged within the prescribed dispute period and where the Buyer provides reasonable supporting evidence.
7.4 Valid grounds for refund consideration may include:
• Non-delivery where courier tracking does not confirm delivery.
• Material misrepresentation of the item compared to the listing description.
• Receipt of an item that is materially defective and not as described.
7.5 Refunds will not be granted for:
• Change of mind.
• Buyer remorse.
• Dissatisfaction based on personal preference where the item matches the listing description.
• Claims made after the dispute period has expired.
7.6 Where applicable and reasonable, ED may require evidence including photographs, packaging documentation, courier records, or additional verification prior to making a determination.
7.7 Where required under the Consumer Protection Act, 2008, statutory rights will apply. Nothing in this Agreement limits rights that cannot legally be excluded.
7.8 ED reserves the right to deny refund requests where abuse, fraud, chargeback manipulation, or misuse of the platform is suspected.
8. Chargebacks & Fraud
8.1 Buyers agree not to initiate unjustified chargebacks.
8.2 If a chargeback is initiated without valid grounds, ED reserves the right to recover associated costs and suspend the Buyer account.
8.3 Fraudulent activity may be reported to payment processors or relevant authorities.
9. Product Nature
9.1 Buyers acknowledge that products may include intimate, personal, or adult-oriented items.
9.2 Buyers accept full responsibility for their purchase decisions.
9.3 ED does not provide warranties beyond those legally required under South African law.
10. Limitation of Liability
10.1 ED provides the platform "as is."
10.2 ED shall not be liable for indirect, incidental, or consequential damages.
10.3 ED’s liability, where applicable, is limited to the value of the transaction.
11. Privacy & POPIA
11.1 Buyer data is processed in accordance with ED’s Privacy Policy.
11.2 Buyer information will not be shared beyond what is necessary to complete the transaction or comply with legal obligations.
12. Account Suspension
12.1 ED reserves the right to suspend or terminate accounts for fraud, abuse, or violation of platform rules.
13. Governing Law
13.1 This Agreement is governed by the laws of the Republic of South Africa.
13.2 Disputes shall be resolved through mediation first, arbitration if necessary, and legal proceedings only as a final resort.
